2. Acceptance of These Terms
By downloading, installing or using the App, you confirm that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you must not use the App.
If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App.
3. Description of the App
Disk Recovery - Media Digger is an iOS photo and video recovery tool designed to help users recover deleted media files. The App may offer both free and premium features, with premium features accessible through in-app subscription purchases.
4. Subscriptions and Payments
The App may offer auto-renewing subscription plans that provide access to premium features. By purchasing a subscription, you agree to the following:
- Billing: All subscription payments are processed through the Apple App Store. By confirming your purchase, you authorise Apple to charge your chosen payment method at the price displayed at the time of purchase, including any applicable taxes.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period (weekly, monthly or annually, depending on the plan you selected) unless you cancel at least 24 hours before the end of the current period.
- Price Changes: We may change subscription prices from time to time. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the subscription after the price change constitutes your agreement to pay the new price.
5. Free Trials
We may offer free trial periods for certain subscription plans. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged. Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID.
6. Cancellation and Refunds
You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that date.
All purchases and refunds are handled by Apple in accordance with Apple's terms and policies. If you wish to request a refund, please contact Apple Support directly or visit reportaproblem.apple.com.
7. Licence Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on a device that you own or control, solely for your personal, non-commercial purposes.
8. Acceptable Use
You agree that you will:
- use the App only for lawful purposes and in accordance with these Terms;
- not attempt to gain unauthorised access to any part of the App, our systems or the systems of our service providers;
- not introduce any viruses, malware or other harmful code;
- not reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the App, except to the extent permitted by applicable law;
- not copy, modify, distribute, sell, lease or sublicense any part of the App; and
- not use the App in any way that could damage, disable, overburden or impair it.
9. Intellectual Property
All content, features and functionality of the App, including but not limited to text, graphics, logos, icons, images, user interface elements and software, are owned by or licensed to MSR Tech LLP and are protected by copyright, trade mark and other intellectual property laws.
10. Third-Party Services
The App may use third-party services including:
- AdMob by Google, for serving advertisements. AdMob may collect and use data in accordance with Google's Privacy Policy.
- Firebase by Google, for analytics and crash reporting. Firebase may collect data in accordance with Firebase's Privacy Policy.
- RevenueCat by RevenueCat, Inc., for in-app subscription management, payment processing and receipt validation. RevenueCat may collect and process transaction data, device identifiers and purchase history in accordance with RevenueCat's Privacy Policy.
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.
11. Disclaimers
To the fullest extent permitted by applicable law, the App is provided on an "as is" and "as available" basis. We do not warrant that the App will be error-free, secure, uninterrupted, or that it will meet your specific requirements. We do not guarantee that any deleted files can be successfully recovered. Nothing in these Terms is intended to exclude or limit any warranties or rights that cannot be excluded or limited under applicable law.
12. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the fullest extent permitted by law, we will not be liable for any loss of profits, loss of data, or for any indirect, consequential or special loss or damage arising out of or in connection with your use of the App. Our total aggregate liability shall be limited to the amount you have paid to us (if any) for the App during the twelve (12) months preceding the event giving rise to the claim.
13. Termination
We may suspend or terminate your access to the App at any time, without prior notice, if we reasonably believe that you have breached these Terms or if required by law. Upon termination, your licence to use the App will immediately cease.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes have been posted will constitute your acceptance of the updated Terms.
15. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
